Can i sue the school?

I live in the state of Texas and the school involuntarily searched my son’s backpack and took out a tape recorder. According to the school policy located in the student handbook involuntary searches can only be conducted with the consent of the student or the parent if there Is reason to believe there are weapons or drugs. I was never notified of the search. The school is keeping the recorder because I believe it has incriminating evidence against my son’s teacher. My son has made claims of her being verbally and physically abusive. I have made complaints to the school about her behavior since Feb. There have also been students removed from her cl and my son states that all of these students where the one’s she use to yell at or be physically abusive toward. Today she allegedly accidently hit my son in the head with a chair. No report was made. I believe whatever happened is on that tape.
